On December 21st, 2020, our firm filed an application to be authorized to bring a class action against DoorDash. This application seeks to obtain a refund for the illegal delivery fees paid by consumers in Québec who placed an order on the DoorDash mobile app or online at www.doordash.com.
DoorDash offers a food delivery service all around the world, through their mobile application and online.
Our client noticed that service fees of 4 %, as well as a 2 $ small order fee for orders under 12 $, were automatically added during purchase on the DoorDash mobile app, fees which were never announced prior to checking out.
The Consumer Protection Act imposes strict obligations to merchants to make sure that consumers have all the required information before buying any goods or service.
Under section 224 c) of this act, merchants cannot charge, for goods or services, a higher price than that advertised. Therefore, the advertised price must include the total amount the consumer must pay for the goods or services, except for applicable taxes, and make sure to specifically single out each underlying fee, including the service fees.
All persons residing in Québec who made a purchase on the DoorDash mobile app or online at www.doordash.com and paid a higher price than that advertised.
