On May 5th, 2021, our firm filed an application to be authorized to bring a class action against Brossard Hyundai. This application seeks to obtain a refund of the additional fees, which were not included in the advertised price in store or online, as well as damages and punitive damages.
The Consumer Protection Act imposes strict obligations to merchants to make sure that consumers have all the required information before buying any goods or service.
Under section 224 c) of this act, merchants cannot charge, for goods or services, a higher price than that advertised. Therefore, the advertised price must include the total amount the consumer must pay for the goods or services, except for applicable taxes, and make sure to specifically single out each underlying fee.
Our clients’ story
Ms. Massicotte and Ms. Nam each wanted to buy a used car that Brossard Hyundai advertised online.
After inspecting the cars and satisfied with the price corresponding to the advertised price, they each made a deposit.
However, upon reading the sales contract, they noticed that extra fees of $429 and $529, called « Forfait Brossard Hyundai », were added to the price of the car.
Ms. Massicotte refused to pay these fees and maintained her offer at the advertised price, but Brossard Hyundai decided not to sell her the car anymore, causing prejudice to Ms. Massicotte.
Ms. Nam, on the other hand, paid these fees without knowing that they were illegal.
All consumers who, since November 21st, 2017, paid or were imposed a higher priced than advertised by the defendant while purchasing a car or after having expressed the desire to purchase a car;
