On March 17th, 2021, our firm filed an application to be authorized to bring a class action against Samsung. This application seeks to obtain a compensation for all Québec consumers who bought one of the Samsung refrigerators reported in Samsung’s service bulletins in 2015 and 2017.
Our clients’ story
Our clients purchased a Samsung refrigerator with French Door External Dispenser built-in-door ice makers in 2014.
After only 4 years of use, they started having problems with this refrigerator. In fact, it stopped making ice due to its ice compartment freezing, and there was water leaking under the « Flex Zone » snack drawer.
Our clients had to manually remove the ice once a month, on top of buying bags of ice at the supermarket and using ice cube trays to make ice.
On a few occasions, our clients had to turn off and unplug their refrigerator during several hours in order to defrost the ice compartment, since they were unable to remove it.
Our clients find that these problems seriously compromise the function of their refrigerator, since it now needs a constant and continuous maintenance from their part, and without it, it becomes useless.
Consumer Protection Act
Under the Consumer Protection Act, goods purchased must be fit for the purposes for which goods of that kind are ordinarily used and must be durable in normal use for a reasonable length of time, having regard to their price and the conditions of their use. In the case of a refrigerator, its reasonable design life is around 18 years.
In its 2015 and 2017 service bulletins, Samsung acknowledged some problems affecting consumers, such as frozen ice chamber and water leakage, as well as some design defects in 56 of its refrigerators with French Door External Dispenser built-in-door ice makers.
However, Samsung continues to commercialize, distribute and sell some of its models to the public, without disclosing these problems. Hence, Samsung failed to mention an important fact in a representation made to a consumer: the quality of its products, which is a key element likely to affect the consumer’s informed decision in purchasing a product.
